A divorce causes stress, and sometimes that stress spills over into everyday life. It’s important not to allow your emotions to get the better of you, or you could end up in a situation like this one.
A woman will not be charged for an altercation involving child custody concerns, according to an Aug. 20 report. The woman has been accused of punching the rear window out of a vehicle before hitting a 12-year-old child in the face. The child’s mother was in the front of the vehicle when this happened.
The woman’s husband and their children were there at the time of the incident. Her husband had signed the children out of school, and she was very emotional, reports show. Her husband had filed for divorce in February around the time when the incident occurred.
It’s alleged that the woman began to scream and upset the children. The woman whose child was hit also sought an order of protection against the woman and told a deputy she did want to file charges. In the end, the woman was arrested on charges of simple battery and disorderly intoxication. The other woman’s order of protection was denied by the courts.
This case is a good example of how working with attorneys and police can help or hurt a case. In this instance, the woman is not facing charges because the victim and witnesses did not cooperate and there were no unbiased witnesses at the scene. The state was unable to file charges due to not having enough evidence to make a case against the woman’s actions.
